Terms and Conditions

Welcome to Sample's and Storyworks, Audio by Elizabeth Sample Audiobook Production (“Company,” “I,” “me,” or “my”). By accessing this website, requesting a quote, booking services, or entering into a project agreement, you agree to the following Terms & Conditions.

If you do not agree, please discontinue use of this website and services.

1. Website Use

This website provides information about professional audiobook services, including but not limited to:

  • Audiobook narration

  • Audio engineering and editing

  • Full audiobook production

  • Soundscape and immersive audio services

  • Portfolio and promotional materials

You agree not to:

  • Use this website for unlawful purposes

  • Copy, reproduce, or redistribute content without permission

  • Attempt to interfere with website security or functionality

2. Intellectual Property

All content on this website—including text, branding, logos, design elements, sample audio, demo reels, and written materials—is the intellectual property of Elizabeth [Last Name], unless otherwise stated.

No ownership rights are transferred through use of this website or inquiry.

3. Audiobook Services & Project Agreements

All audiobook projects are governed by a separate signed Audiobook Production Agreement, which defines:

  • Scope of work

  • Pricing (PFH or flat rate)

  • Delivery timelines

  • Revision policies

  • Payment structure

In the event of any conflict between these Terms & Conditions and a signed contract, the signed Audiobook Production Agreement shall take precedence.

4. Licensing & Ownership

Upon full payment of a project, the Client receives a perpetual, non-exclusive license to use, distribute, publish, and commercially exploit the completed audiobook recordings.

The Client retains full rights to their manuscript and underlying intellectual property.

The Producer retains ownership of:

  • Voice and vocal performance rights

  • Name, likeness, and professional identity

  • Studio methods, processes, and workflows

  • All unreleased or unused material

5. AI Voice & Voice Cloning Restriction

Client may not use, reproduce, train, synthesize, clone, or otherwise replicate Producer’s voice, vocal performance, or likeness using artificial intelligence, machine learning, or similar technologies without prior written consent.

This includes, but is not limited to:

  • Text-to-speech training

  • Voice cloning software

  • AI-generated narration models

  • Synthetic voice replication

Unauthorized use constitutes a violation of these Terms and may result in legal action.

6. Portfolio & Promotional Use

Unless otherwise agreed in writing, Producer may use excerpts of completed audiobook projects for:

  • Portfolio demonstration

  • Website samples

  • Social media content

  • Demo reels

  • Marketing and promotional materials

No full audiobook will ever be shared publicly without Client permission.

Clients may request a delay in promotional use until official release.

7. Payment Terms

  • All prices are listed in USD

  • A signed contract and deposit are required before production begins

  • Payment schedules are outlined in the Audiobook Production Agreement

  • Late or incomplete payments may result in paused or withheld delivery

8. Revisions & Project Changes

Narration or production errors are corrected at no additional charge.

Changes to the manuscript after recording begins may result in additional fees or timeline adjustments.

Revision limits vary by service package.

9. Delivery

Final audiobook files are delivered electronically after:

  • Completion of production

  • Final approval

  • Receipt of full payment

Clients are responsible for downloading and backing up all files upon delivery.

10. Project Delays & Force Majeure

Production timelines are estimates and may be affected by:

  • Illness or injury

  • Family emergencies

  • Equipment or software failure

  • Power or internet outages

  • Severe weather or natural disasters

  • Other circumstances beyond reasonable control

In such cases, the Producer will notify the Client as soon as possible and provide a revised timeline.

These delays do not constitute breach of contract.

11. Confidentiality

Unpublished manuscripts, project materials, and client information are treated as confidential and will not be shared without permission, except where required by law.

12. Limitation of Liability

To the fullest extent permitted by law, Elizabeth [Last Name] shall not be liable for:

  • Loss of income or business opportunity

  • Publishing or distribution outcomes

  • Technical issues beyond reasonable control

  • Indirect or consequential damages

13. Governing Law

These Terms & Conditions are governed by the laws of the State of Florida, United States.
